Fixing Fashion: Why the UK Needs New Rules (And What Retailers Can Do Now)

The Fashion Industry’s Regulatory Wake-Up Call

The UK fashion industry is on notice. A new white paper from campaign group Fashion Declares and law firm Bates Wells warns that Britain is falling behind in the global race to reform fast fashion. Titled The Future of Fashion Regulation in the UK, the report lays out three urgent policy recommendations to clean up the sector:
  1. Close the de minimis tax loophole that allows overseas retailers to undercut UK businesses.
  2. Enforce Extended Producer Responsibility (EPR), to hold brands accountable for the full lifecycle of their products.
  3. Introduce Digital Product Passports to bring transparency and traceability to every garment.
These proposals are more than a call for fairness. They are the blueprint for a circular, ethical and competitive fashion economy.

What’s Going Wrong: Cheap Imports and Fashion Waste

Today’s fashion market is being flooded with ultra-cheap imports. Thanks to the de minimis VAT exemption, international sellers can ship items worth less than £135 into the UK tax-free. This loophole undercuts UK-based brands and fuels the throwaway culture of fast fashion. The result? A deluge of waste. Discarded garments pile up in landfills, get shipped overseas for incineration, or end up in unauthorised resale channels – often without any accountability. The UK currently lacks strong oversight on textile disposal and post-sale responsibility. As the white paper points out, without reform, the UK will miss its chance to lead on sustainable fashion and instead remain complicit in harmful, short-term business models.

Why Brands Can’t Wait for Regulation

Yes, regulation is coming, but it’s not here yet. And waiting is no longer a viable strategy. The fashion and retail sectors are already under increasing pressure from consumers, investors and stakeholders to prove their environmental credibility.Extended Producer Responsibility (EPR) for textiles is already gaining traction across the EU and is under active discussion in the UK. EPR legislation will require producers to finance the collection, recycling and proper disposal of clothing. Brands that ignore this shift risk being blindsided by future compliance costs and reputational fallout.Similarly, Digital Product Passports will soon become standard in Europe. These digital IDs will store key data about a garment’s origin, material content, and recyclability, enabling full transparency across the supply chain. Forward-thinking brands will start preparing for this now, rather than scrambling later.

Avena: Helping Fashion Act Responsibly Today

Forward-looking brands aren’t just thinking about new rules – they’re building better systems now. That’s where Avena’s SecureBrand® textile destruction service steps in.Avena provides secure, traceable and environmentally responsible disposal for uniforms, unsold inventory, and textile samples. Their process ensures that no item ends up in landfill or in the wrong hands. Instead, garments are shredded and repurposed, with full reporting and chain-of-custody tracking—supporting the principles of EPR before it's mandatory.Whether you’re looking to dispose of seasonal samples or securely destroy branded stock, Avena helps you stay compliant, sustainable and brand-safe.

Be A Brand That Leads, Not Follows

The message is clear: the rules are changing, and the time to act is now. Regulation will soon mandate what many forward-thinking fashion and retail brands are already doing – rethinking waste management, embracing transparency and taking responsibility.By partnering with Avena and aligning your operations with emerging EPR and product passport frameworks, you won’t just be keeping up – you’ll be setting the standard. Interesting in learning more about our services? Speak to one of our experts today.Looking for a quick quote for secure destruction & recycling? Get a quote today.
